Dear Neighbors,
This afternoon I was called by Mr. Eloy LaQue at District 8 with a final word regarding the egress cut onto WBM from the business located at WBM and Babcock. As a result of DSD digging further into regulations regarding the zoning of WBM, it was found that WBM is classified as a Class B street with a vehicular access easement. In short to Dreamhill Estates it means that the egress “cannot” be poured and we can expect the form to be removed. The details of this include the following.
According to the Development Services Dept. (DSD), WBM *is* classified as a Class B street, technically allowing for the building owner to create that driveway if they choose to, BUT the platte has what is called a vehicular access easement.
This means that there needs to be 125′ distance from Babcock, when building a new driveway, as well as 125′ easement from the nearest residential house, next door. The total property distance on the WBM side is 200′ feet, which does not allow for the vehicular easement from both sides of the property, so DSD is notifying the owner that he/she cannot pour the driveway.

The owner does have the right to amend the platte without City Council approval, but only on the condition that they widen the road to be 20′ from the midline of the road to the beginning of the driveway rise. This would mean that the owner would have to tear up & repave the left hand side (coming from Babcock) of the road. Interestingly, they are not required to repave the entire road! But Mr. Martinez indicated in order to do the street alterations, it is very expensive.
Councilman Nirenberg suggested that we as a neighborhood association collect the general consensus about whether we want to permit this business owner to widen WBM 200′ and cut access from his parking lot onto WBM, or not allow any of that, just in case the owner pursues widening WBM!

The folks at our District 8 office and Development Services Department deserve a huge “thank you” for working closely and swiftly in response to our requests!
This topic will be discussed at our next Board meeting on Thursday, January 23rd, 7:15pm. Councilman Ron Nirenberg and Mr. Eloy LaQue have been invited to attend the meeting to meet the Dreamhill Estates community and answer questions you may have. I encourage all neighbors to please attend the meeting. More notices will be sent out and signs posted like always.
On another note, Dr. John Junghans, DDS who has the dentist clinic on the corner of WBM and Babcock across from this office building we’ve been dealing with, notified me that he will be having repair work done on his main sewer line soon. During that time they will be cutting into his property on WBM and my understanding, onto WBM in order to connect to the City line. Point is, when you see this happen Dr. Junghans is in compliance with the City regarding permits and he is not cutting an egress onto WBM!
